Terms of Use

These Terms of Use (“Terms”) govern your access to and use of ZeusPing — including the hosted hub at hub.zeusping.com and the ZeusPing Pulse software (together, the “Service”) — operated by Zeus Systems Inc (“Zeus Systems”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ZeusPing provides website and infrastructure uptime monitoring, including external HTTP checks and internal monitoring via Pulse nodes. We may add, change, or remove features at any time.

2. Accounts

You must provide accurate information and be old enough to form a binding contract. You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use of your account.

3. Acceptable Use

You agree to use the Service only for systems you own or are authorized to monitor, and in compliance with all applicable laws. You must not:

• monitor, scan, or probe systems you do not own or have no authorization to test;
• attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
• resell or provide the Service to third parties except as expressly permitted;
• use the Service for any unlawful, harmful, or abusive purpose.

4. ZeusPing Pulse Software

The ZeusPing Pulse application is licensed, not sold, and is governed by the End User License Agreement (EULA) provided with it. Pulse is proprietary software; you may not reverse engineer, modify, or redistribute it except as the EULA expressly allows.

5. Plans and Fees

The Service is currently offered free of charge. We may introduce paid plans in the future. If we do, we will provide notice, and you will not be charged without your agreement.

6. Intellectual Property

ZeusPing, the ZeusPing and Pulse software, and all related content, designs, and trademarks are owned by Zeus Systems Inc and protected by law. All rights reserved. Except for the limited right to use the Service under these Terms, no rights are granted to you.

7. Monitoring Disclaimer

Important: ZeusPing is a monitoring aid, not a guarantee. We do not warrant that checks or alerts will be timely, accurate, uninterrupted, or delivered. You must not rely on the Service as your sole means of detecting outages or as a substitute for your own operational safeguards.

8. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Zeus Systems Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, including any damages arising from missed, delayed, or inaccurate alerts or from downtime of your systems. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100.

10. Indemnification

You agree to indemnify and hold harmless Zeus Systems Inc from claims, losses, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will revise the “Last updated” date above, and your continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Canada and the Province in which Zeus Systems Inc is incorporated, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of that Province for any dispute arising out of these Terms or the Service.
